ChickUp Application

1. Purpose of the Application

ChickUp is a personal tracking application designed for users to monitor their nutrition, water intake, macro values, and other daily health-related records.

ChickUp is a tracking tool only. It does not provide diet programs, meal plans, medical diagnosis, clinical recommendations, or health guidance of any kind.

2. Account Creation and Security

The User:

  • May log in to the application using their Google account.
  • Is responsible for keeping their credentials secure and confidential.
  • Is responsible for all activities carried out under their account.
  • Is required to provide a valid date of birth during registration for age verification purposes.

3. User Obligations

The User agrees:

  • To use the application for lawful purposes only.
  • Not to enter misleading or false information, including false age information.
  • Not to perform any actions that may harm the system or other users.
  • Not to violate the rights of other users.
  • Not to use automated tools, bots, or scripts to interact with the App.

4. Age Requirements and Verification

By using the App, you represent that you are at least 13 years of age. ChickUp does not knowingly permit use by children under 13. During registration, users are required to provide their date of birth for age verification, and accounts indicating an age below 13 will not be created.

Users between the ages of 13 and 17 may only use the App with the explicit consent and supervision of a parent or legal guardian. Because use of the App requires a paid subscription after the 7-day free trial, the parent or legal guardian must provide consent, authorize any payment, and take responsibility for managing the subscription (including cancellation). Payment card and Google Play account information must belong to the parent or legal guardian, not the minor.

If a user falsely declares their age, ChickUp cannot be held responsible.

5. Access to the Application and Subscription Model

ChickUp is available for free download from the Google Play Store. However, access to and use of the App's features requires an active subscription after account registration.

5.1 Subscription Plans and Pricing

ChickUp offers monthly and annual subscription plans. Subscription prices vary by country and are automatically set by Google Play based on the user's region. Example pricing:

  • Turkey: 79.99 ₺/month or 659.99 ₺/year
  • United States: $3.99/month or $19.99/year
  • Other countries: Localized pricing automatically set by Google Play in the user's local currency

The exact price, billing frequency, and currency applicable to your region will be clearly displayed within the App and on the Google Play Store purchase screen before you confirm your subscription.

5.2 7-Day Free Trial

Upon registration, users are required to enter valid payment information through Google Play Billing to start a 7-day free trial. During this 7-day trial period:

  • No charges will be made to the user's payment method.
  • The user has full access to the App's features.
  • The user may cancel the subscription at any time before the end of the 7-day period without being charged.

If the user cancels the subscription during the 7-day free trial, the subscription will end at the conclusion of the 7-day trial period, and no charges will be made to the user's payment method.

5.3 Subscription Activation and Renewal

If the user does not cancel the subscription before the end of the 7-day free trial, the subscription will automatically activate on the 8th day, and the applicable subscription fee (as displayed at the time of registration) will be charged to the payment method on file via Google Play Billing. The subscription will automatically renew at the end of each billing cycle (monthly or annually, depending on the selected plan) unless canceled by the user at least 24 hours before the end of the current period, in accordance with Google Play's subscription rules.

5.4 Payment Processing

All payments, subscriptions, renewals, and refunds are processed exclusively through Google Play Billing and are subject to Google Play's terms and policies. ChickUp does not collect, store, or process payment card information directly.

5.5 Subscription Cancellation

Users may cancel their subscription at any time through the "Cancel Subscription" button located at the bottom of the Profile section within the App. This button redirects the user to their Google Play Subscriptions page, where cancellation can be completed with a single tap. Users may also cancel their subscription directly through Google Play account settings at any time.

Cancellation during the 7-day free trial will prevent any charges; access will end at the conclusion of the trial period. If the user cancels after the trial period, access to subscription features will continue until the end of the current billing cycle, and the subscription will not renew.

Deleting the application from your device does not cancel your subscription. Subscriptions must be canceled through the methods described above.

5.6 Refunds

Refunds are handled exclusively through Google Play and are subject to Google Play's refund policies. Users may request a refund directly from Google Play by visiting: https://support.google.com/googleplay/answer/2479637

Where required by applicable law (including EU, UK, and certain other jurisdictions that provide statutory withdrawal or refund rights), users may also contact us at info@fineappstudio.com to request a refund in accordance with those legal rights.

6. No Advertising

ChickUp does not display advertisements within the App. The App is supported entirely through its subscription model.

7. Health Disclaimer

Information and data summaries provided within the application do not constitute medical advice, dietary recommendations, or clinical guidance.

Any calorie targets, macro summaries, or goal calculations displayed by the App are for informational tracking purposes only and should not be treated as professional health advice.

The developer shall not be held responsible for health issues or risks arising from use of the application. Users should consult a qualified healthcare professional for health-related decisions.

8. Third-Party Services

The App uses third-party services including but not limited to Firebase (Firestore, Authentication, Analytics, Crashlytics) and Google Play Billing. These services operate under their own terms and privacy policies. By using the App, you also agree to the applicable terms of these third-party services.

9. Access to Legal Documents

Users can access this Terms of Service and the Privacy Policy at any time from within the App by navigating to the Profile section and scrolling to the bottom. These documents are also available via the links provided in the Google Play Store listing.

10. Account Deletion

Users may permanently delete their account or sign out at any time by navigating to the Profile section and scrolling to the bottom of the page within the App.

Account deletion is irreversible. Upon deletion, all personal data will be removed or anonymized in accordance with applicable law. Active subscriptions must be canceled separately through Google Play Subscriptions settings before deleting an account, as deleting the account within the App does not automatically cancel an active subscription.

11. Intellectual Property Rights

All designs, content, software codes, trademarks, logos, and other intellectual property elements within the application belong to the developer or are used under license. These elements may not be copied, reproduced, distributed, or used for commercial purposes without the developer's written permission.

12. Service Modifications

The developer reserves the right to:

  • Modify or update the features of the application.
  • Temporarily suspend or discontinue the service.
  • Add or remove features.
  • Change subscription pricing, with at least 7 days' prior notice to existing subscribers (or a longer period where required by Google Play policies or applicable law). Price changes will not take effect without the user's continued use of the subscription after the notice period.

ChickUp reserves the right to restrict, suspend, or terminate user access at its sole discretion for conduct that violates these Terms or harms other users or the App's integrity.

13. Limitation of Liability

The application is provided "as is." To the maximum extent permitted by applicable law, the developer shall not be liable for:

  • Data loss or service interruptions.
  • Loss of income or indirect/direct financial damages.
  • Health problems or decisions made based on app data.

The User acknowledges that they use the application at their own risk. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law (such as statutory consumer protection rights in the EU, UK, or Turkey).

14. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Republic of Turkey. Any disputes arising from or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the Courts and Enforcement Offices of İzmir, Turkey. This clause does not affect any mandatory consumer rights that may apply under the laws of the user's country of residence.

15. Changes to the Terms

These Terms may be updated. Material changes will be communicated through the App or via other appropriate means. Continued use of the application after updates constitutes acceptance of the revised Terms. The current version is always accessible within the App.
